Michigan Supreme Court denies Spitler conviction appeal

JACKSON, Mich. — The State Highest Court has issued an order in the case of Riley Spitler

The Michigan Court of Appeals threw out the murder conviction of Ryan Spitler in summer of 2018.

Spitler was found guilty of second degree murder in the 2014 shooting death of his older brother Patrick in their Blackman Township Home. At the time of the murder, Riley Spitler was 16.

Court documents show the Michigan Supreme Court issued an order denying to review the State Appeals Court Ruling that tossed the conviction.

The Appeals Court says the judge made a mistake in allowing some testimony about what the victim had told his friends about Riley.

He always claimed the shooting was an accident and any appeal has been rejected by that State’s Highest Court.

The Jackson County Prosecutor is reviewing the ruling and now has to decide whether to allow Riley Spitler to be re-sentenced on a lesser charge of manslaughter or take the case to trial again.

The Court of Appeals did affirm marijuana delivery and felony firearm charges against Spitler. He was sentenced to four to six years in prison for those offenses in 2016. By Julie Williams[wilx.com]
