JACKSON COUNTY, Mich. — Judges on the Michigan State Court of Appeals have ruled against the appeal of the Jackson County mother convicted of abusing her own children. Records show the Appeals Court have issued an order affirming the conviction of Tina Harbert.
Harbert was convicted on first-degree child abuse charges in 2017 for failing to protect her children from their abusive father, James Harbert.
Child abuse charges were initially issued against Tina and James in September 2015, after a source reported to police as having seen one of the Harbert’s children had serious injuries.
Police then found the couple’s other child had similar injuries and removed the children from the home.
Tina Harbert was sentenced to five to 20 years in prison after being convicted on child abuse charges. In her appeal she argued evidence presented at her trial was not enough to convict her of First-Degree Child Abuse when James Harbert was the one abusing their children.
The Appeals Court disagreed and affirmed her conviction, saying Tina did not try to stop James.
James Harbert was sentenced to 20 to 40 years in prison after pleading guilty to several charges of First-Degree Child Abuse in 2017.
Tina Harbert will be eligible for parole in three years, in 2022.
