A Jackson man tried another attempt at starting a recall effort against Jackson County Sheriff Steve Rand.
But on Wednesday, the State Board of Canvassers said they need hard evidence to recall Rand.
Wednesday's recall petition was the second submitted by Dean Schuette.
His first petition was denied by the state earlier this month, because it wasn't specific enough.
Schuette's son, Tommy, released video recordings of Sheriff Rand making sexist and racist comments about women and minorities as part of a lawsuit he filed against Rand. But the board on Wednesday said the newspaper articles of the tapes are not enough evidence.
Rand admitted to making the comments and apologized, but he has refused to step down.
