A motion to disqualify Ingham County Judge Rosemarie Aquilina from Larry Nassar's appeal has been denied.
The case went to Ingham County Chief Judge Richard Garcia earlier this month after Judge Aquilina denied the motion. Nassar's attorneys claimed she was biased when she sentenced Nassar to 40-175 years in January.
Nassar claimed statements made by Judge Aquilina led to him being attacked in federal prison. Those statements included her saying, in summary, if the Constitution allowed cruel and unusual punishment, she would allow others to do to him what he did to so many young women.
In his ruling, Judge Garcia said "the die was cast in the courtroom and Defendant's sentence was forged by his own words and deeds. Consideration of whether he should be resentenced can be fairly reviewed by the judge uniquely situated to provide justice in this case. The judge who heard these survivors is the only one who should properly render any re-sentence."
