The main contractor on the US-127 sound wall, that was supposed to be finished a year ago, will be fined.

FOX 47 News has learned MDOT is going to hit Toebe Construction for $2,650 for each day the project is overdue.

Winter months, when construction can't be done, won't count toward the total.

JoAnne Bump has lived next to US-127 northbound for more than 30 years, and she's been waiting for the noise to be toned down by a soundwall for two years now.

"Last year they told us they were going to finish it in October and a whole year went by and now it just seems like it's just going on and we don't even know why it's not going on."

It's because MDOT's contractor didn't make panels that met quality standards, so this spring a different subcontractor, ADL Systems in Portland, restarted the process.

"The folks that have lived along this project have suffered since last spring, first thing we did was remove their trees. And they've been patient and I greatly appreciate that and I know the department appreciates it. And all I can say is we're sorry and we're going to continue to work to complete the project and we greatly appreciate their patience," says Gregory Losch.

That patience will have to hold until at least the end of October. That's when construction will resume. That's because MDOT's Gregory Losch says they want close to the 1400 panels they need to get the project done before they start putting them in.

Problem is, every day that passes past the deadline means a fine of close to three-thousand dollars per day. MDOT plans to pin that on the contractor.

Meanwhile, all neighbors care about is that it's completed sometime soon, and they're looking forward to what they'll be able to do once it's finished.

MDOT says with what's left of the construction, snow won't affect it, and they can get to work once those panels are complete.
