The Eaton County Prosecutor says the death of Mark Mazurek at his girlfriend's hands was self-defense.
It happened in her home in Charlotte on August 10, 2015.
Police say she shot Mazurek after he threw her down the basement stairs, then threatened to cuff her to a post and kill her and their baby.
The prosecutor says she had a gun in a holster but didn't use it until she was literally backed into a corner.
Mazurek had been reported for domestic violence several times.
