Michigan Attorney General Dana Nessel is appealing a court decision that allowed a deal between Enbridge Energy and former Gov. Rick Snyder's administration to stand.
Nessel said the deal violated the state's Constitution, which meant all the agreements included in it would be thrown out. Enbridge sued the state in the Michigan Court of Claims as a result.
In October, the court ruled in Enbridge's favor, allowing the deal to stand.
Immediately after the ruling, Nessel and Gov. Gretchen Whitmer promised to challenge the ruling. On Thursday, Nessel did that by taking the case to the Michigan Court of Appeals, asking it to reverse the claims court's decision.
The state argues the deal between Snyder and Enbridge violates the Michigan Constitution by not providing fair notice of the content of the law and that it embraces two objects: the tunnel running beneath the Straits of Mackinac and the Mackinac Bridge.
