Judge says state can't give tax dollars to private schools

A judge has struck down a Michigan law that provides millions of dollars in state aid for private schools.

Court of Claims Judge Cynthia Diane Stephens issued her ruling Thursday. Public school groups had challenged $5 million appropriations spread over two years to private schools for fire drills, inspections and other state requirements.

The judge says the spending -- which was frozen during the lawsuit -- violates the Michigan Constitution's ban on aid for non-public schools.
