JACKSON, Mich. — A gay-rights activist charged with arson is asking a judge to block two witnesses from testifying at trial.

Nikki Joly is charged with setting his house on fire in Jackson in 2017.

The defense on Friday argued police only found the two witnesses because they read an email between Joly and his attorney.

Prosecutors told the judge they did not know the email was between Joly and his attorney, and they have no intention of presenting the email at trial.

The witnesses in question are expected to testify that Joly asked them to store a lawnmower and gas can from the scene of the fire.

The judge has three weeks to make a decision.
