ANN ARBOR, Mich. — One of the sexual harassment claims against University of Michigan Professor David Daniels has been dismissed, but an attorney says that will not impact the federal lawsuit against him.

Daniels is an Opera professor at the University of Michigan who has been accused of sexually assaulting a former student.

Andrew Lipian is a former University of Michigan student who claims Daniels served him alcohol and sleeping pills before sexually assaulting him at Daniels's home in March 2017. He filed the lawsuit against Daniels in October 2019 and Lipians's attorney says the fact that a count has been dropped in the case will not affect the federal lawsuit.

The lawsuit also claims Daniels sent sexual photos and videos to Lipian and that Daniels asked for the same in return from Lipian.

The lawsuit also says a faculty member was aware of the assault and reported it to the University's Office of Institutional Equity.

Daniels has denied the allegations and says they are, "Both false and malicious."

Lipian is the third individual to accuse Daniels of misconduct.

The professor took a leave of absence from the university in the Fall of 2019 because of claims he and his partner sexually assaulted a performer in 2010. Daniels denies both allegations.

A scheduling conference is set for Wednesday, January 23 at 3 p.m. in Detroit's Federal Court.
